Terms of Use

The Platform is licensed, not sold. Gusana grants you a personal, non-exclusive, non-transferable, revocable license to use the Platform on your devices for personal, non-commercial wellness purposes. This license does not convey any ownership rights. All rights not expressly granted here are reserved by Gusana.

You may not copy, distribute, modify, reverse-engineer, decompile, or create derivative works from the Platform. You may not use the Platform for any commercial purpose, resell access, or transfer your account to another person. You may not use the Platform in any way that could harm other users, our therapists, or the integrity of the service. Accounts found in violation of these restrictions may be suspended or permanently removed.

All intellectual property in the Platform — including the app, web interface, brand assets, AI models, content library, and platform design — is owned exclusively by Gusana. No rights are transferred to you by these terms. You may not remove or obscure any copyright, trademark, or proprietary notices from any part of the Platform.

The Platform is provided 'AS IS' without warranty of any kind. We make no guarantees that the Platform will be error-free, uninterrupted, or meet every user's specific needs. Wellness content, AI responses, and journaling tools are provided for informational and supportive purposes only and are not warranted as accurate, complete, or suitable for any particular health condition.

To the fullest extent permitted by applicable law, Gusana shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Platform, including but not limited to emotional distress, reliance on wellness content, or interruptions to therapist session access. This includes claims related to subscriptions, in-app purchases, AI companion interactions, or therapist bookings.

This limitation applies regardless of the legal theory under which a claim is brought — whether contract, tort, negligence, or otherwise. Where local law does not permit certain exclusions, our liability is limited to the maximum extent permitted in your jurisdiction.

For subscription plans, Gusana's maximum liability shall not exceed the fees paid in the most recent billing period. For any individual therapist session purchase, our liability shall not exceed the price paid for that session.

Your journal entries are stored locally on your device and are never read, scanned, or sold by Gusana. If you enable cloud backup, your data is encrypted in transit and at rest before leaving your device. Therapist session metadata (booking times, session notes) is stored securely and shared only with your therapist. You agree to indemnify and hold Gusana, its team, therapists, and partners harmless from any claims, damages, or expenses arising from: (i) your use of the Platform in violation of these terms; (ii) content you submit or share through the Platform; or (iii) any misrepresentation you make in your account or during therapist sessions.

Gusana may release updates to improve the Platform, fix issues, or comply with new regulations. Continued use after an update constitutes your acceptance of any changes. We will notify you of material changes through the app or by email.

If a feature you have purchased is removed or substantially changed due to technical or legal requirements, we will endeavour to offer a comparable replacement. Refunds for one-time purchases will only be issued where required by applicable law.

Gusana shall not be liable for any inconvenience caused by updates, feature changes, or temporary service interruptions, provided such changes are made in good faith and in accordance with these terms.

Gusana is a mental wellness tool, not a medical service. The Platform — including AI companion responses, mood tracking, journaling prompts, breathing exercises, and content articles — does not constitute medical advice, diagnosis, or treatment. Therapist sessions on Gusana are provided by independently licensed professionals; Gusana facilitates access but is not a healthcare provider. Always consult a qualified medical or psychiatric professional for health decisions. If you are experiencing a crisis or emergency, please contact your local emergency services or a crisis helpline immediately. Do not delay seeking professional help based on anything you encounter in this app.

Subscriptions

Gusana offers the following access tiers:

• Free Plan: Full access to core journaling, mood tracking (30 options), Healing Journey exercises, and the AI Companion — forever free, no ads, no account required.
• Premium Trial: New users may access Gusana Premium features free for a limited trial period. No payment is required until the trial ends, and you may cancel at any time before it does.
• Gusana Premium: A paid subscription ($4.99/month or $39.99/year) that unlocks advanced mood analytics, Year in Pixels heatmap, unlimited AI check-ins, end-to-end encrypted cloud backup, therapist session access, and data export. Premium is available via the Apple App Store, Google Play Store, or directly through our website using Paystack. Subscription management and refund eligibility through third-party platforms are governed by Apple's or Google's respective payment policies.

Gusana Premium is available as a monthly or annual plan. For billing purposes, a month is 30 calendar days and a year is 365 calendar days.

Monthly Premium renews automatically every 30 days. Your payment method will be charged at the start of each billing cycle. To avoid being charged for the next cycle, you must cancel at least 24 hours before renewal. Partial-month refunds are not available.

Annual Premium is charged as a single upfront payment and renews automatically after 365 days. To avoid renewal charges, cancel before your renewal date. Partial-year refunds are not available except where required by law.

Therapist Session Purchases

In addition to subscriptions, users may book individual therapist sessions through the Platform. The following terms apply to session purchases:

• Cancellation Policy: Sessions cancelled at least 24 hours in advance are fully refundable. Sessions cancelled within 24 hours of the scheduled time are non-refundable. No-shows forfeit the session fee.
• Session Responsibility: Gusana facilitates the connection between you and licensed therapists but is not responsible for the content of sessions or therapeutic outcomes. Therapists on Gusana are independent practitioners.
• Payment Processing: Session payments are processed securely via Paystack. By completing a payment, you agree to Paystack's applicable terms of service.
• Non-Transferable: Booked sessions are tied to your Gusana account and may not be transferred, gifted, or resold to another user.

Gusana's wellness content — including guided meditations, breathing exercises, journaling prompts, and articles — is created for general supportive use and is not tailored to individual medical histories. During any free trial period, you have full access to evaluate Premium content before committing to a paid plan.

Some content may vary by region or device. AI Companion responses are generated based on your in-app interactions and are intended to be supportive, not diagnostic. Content is updated regularly to reflect evidence-based practices in mental wellness.

Gusana reserves the right to update these Terms at any time. We will notify you of significant changes via in-app notice or email at least 14 days before they take effect. Continued use of the Platform after changes take effect constitutes your acceptance of the revised terms. The most current version is always available at gusana.me/terms.
